1. Acceptance of Terms
By accessing our website, requesting a website draft, or subscribing to any of our managed design and hosting services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.
2. Description of Managed Services
arbrax provides a done-for-you website management service. Unlike DIY site builders or complex agencies, we build, host, optimize, and edit websites on behalf of our clients. Our services include:
- Free Initial Draft: We research your business and build a fully customized homepage draft for free before you pay anything.
- Subscription Plans: Once you review and approve the draft to go live, you start a subscription plan (Starter, Growth, or Pro) as described on our pricing page.
- Hosting & Custom Domain: We manage web hosting and link custom domain names for all active plans.
- SEO Configuration: Standard or advanced local SEO integration, including meta tag generation, schema layouts, and sitemap generation.
3. Client Content and Assets
You retain full ownership of all logos, text copy, testimonials, project photos, domains, and business details you submit to us to build your website.
By submitting assets, you represent and warrant that you own or have the necessary rights to use those materials. You grant arbrax a non-exclusive, worldwide, royalty-free license to use, display, modify, and format your content strictly to create, host, and maintain your business website.
4. Unlimited Updates & Edit Policy
All active plans include unlimited content edits and updates completed within 24 hours of request.
- Standard Edits (Included): Covers swapping existing layout photos or text, updating business hours, changing contact fields, adding customer reviews, inserting a new blog post, or adding a new page using existing layout styles.
- Structural Rebuilds (Excluded): Major site overhauls, custom database development, custom application coding, or third-party CRM systems that require custom integrations are not covered by the standard subscription. We will provide a separate quote for these if requested.
5. Subscription Billing, Fees, and Locked Pricing
All subscriptions are billed on a recurring monthly or annual basis starting the day your website goes live.
- No Onboarding/Setup Fees: We do not charge onboarding or design setup fees.
- Locked Rates: Your monthly rate is locked forever at the price you sign up for. We do not increase rates on renewal cycles.
- Upgrades and Downgrades: You can switch plans (e.g. from Starter to Growth) at any time. Changes will be prorated automatically.
- Annual Plans: Annual billing cycles offer a 10% discount and auto-renew at the same discounted annual rate.
6. Cancellation and Website Backups
arbrax plans are month-to-month with no contracts or lock-ins.
You can cancel your subscription at any time. Upon cancellation, your website will remain online until the end of your current billing cycle, at which point it will be taken offline and billing will stop immediately.
Website Backups: If you cancel, we save a backup archive of your website design and files in our vault for free. If you ever decide to restore your site in the future, we can restore it instantly at no extra cost.
7. Refund Policy
Because we build a complete custom draft of your site for free before any payment is required, you only begin your subscription when you are 100% satisfied. Once a subscription charge has been processed, we do not offer refunds, but you can cancel at any time to prevent future billing.
8. Intellectual Property of Layouts
The layout templates, custom CSS files, animations, and proprietary scripts created by arbrax to compile and run your site remain the property of arbrax. You are granted a license to use these assets for your website while you maintain an active subscription.
9. Limitation of Liability
arbrax is provided "as is" and "as available". We do not guarantee that your website will remain online 100% of the time, nor do we guarantee specific rankings in search engine algorithms (which are governed by external search engines). We are not liable for any direct, indirect, incidental, or consequential damages resulting from website downtime, lost leads, or domain routing issues.
